1. Definitions
1.1 “Service” – Any hosting, support, software, or website functionality we provide.
1.2 “Account” – The Client profile created to access and manage the Services.
1.3 “Uptime” – The percentage of time the primary network and power are available, measured monthly.
1.4 “Content” – All data, files, mods, plugins, text, images, or code uploaded to, or generated on, the Service by Client.
3. Acceptable Use Policy (AUP)
The following activities are strictly prohibited: Distributing malware, viruses, or engaging in DDoS attacks.
Hosting or linking to content that infringes copyright or trademark.
Operating servers for harassment, hate speech, or illegal activity.
Using exploits, cheats, or “cracked” game clients.
Any activity that consumes excessive resources or disrupts other Clients.
Violations may result in immediate suspension or termination without refund.
4. Service Level Agreement (SLA)
Uptime Commitment: 99.9% monthly network & power uptime.
Maintenance Windows: 24-hour notice for planned maintenance; emergency maintenance excluded from SLA.
Credit: For downtime exceeding SLA, we credit 5% of monthly fee per 30 minutes of qualifying outage, up to 100% of that month’s fee. Credits must be requested within seven (7) days of incident.
5. Orders, Billing & Refunds
5.1 Billing Cycle – Monthly in advance unless stated otherwise.
5.2 Auto-Renewal – Subscriptions renew automatically; you may cancel anytime in the billing portal.
5.3 Late Payment – Accounts 3 days past due may be suspended; data is deleted after 14 days of non-payment.
5.4 Refund Policy – 24-hour no-questions refund from first purchase. Renewals are non-refundable.
5.5 Charge-backs – Filing a charge-back voids SLA credits and may incur a $25 dispute fee.
6. Privacy Policy (Summary)
Data Collected: email, IP address, payment identifier, support tickets, usage logs.
Purpose: account creation, billing, analytics, fraud prevention.
Retention: data kept for the life of the account + 3 years, unless law requires longer.
Your Rights: access, rectify, erase, or port personal data (GDPR Articles 15-20).
Sub-processors: Stripe (payments), WHMCS (client portal), Cloudflare (CDN).
A full standalone Privacy Policy is incorporated by reference.
7. Copyright & DMCA Policy
We observe the Digital Millennium Copyright Act (“DMCA”). If you believe Content hosted on our Service infringes your copyright, send a notice to:

8. Termination
You may cancel at any time via the client portal; service remains active until period end.
We may suspend or terminate immediately for AUP violations, court orders, or non-payment.
Data Deletion: Deleted 7 days after termination; backups purged within 30 days.
9. Warranty Disclaimer
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Limitation of Liability
To the maximum extent permitted by law, our total liability for any claim arising under these Terms will not exceed the fees you paid in the three (3) months preceding the event. IN NO EVENT ARE WE LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.
11. Indemnification
You agree to defend, indemnify, and hold Fort Host, its officers, and employees harmless from any third-party claims arising out of: (a) your Content; (b) your violation of these Terms; or (c) your violation of law.
12. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law rules. Any dispute shall be resolved by binding arbitration in Dallas County, Texas, except either party may seek injunctive relief in court to protect intellectual-property rights.
13. Support & Escalation
Standard support via ticket: 24-hour response target.
Emergency network issues: 1-hour response target.
Paid Priority Support available as an add-on.
